Welcome to the MyRenovation app and Bestrenovate platforms! Thanks for using our products and services («Services»). The Services are provided by LLC RADME.RU («Radme.ru» or «Administration»). By using our Services, you are agreeing to these terms. Please read them carefully. IF YOU DO NOT AGREE TO THESE TERMS, PLEASE DO NOT USE THE SERVICES.

1. Preamble, General Provisions, and Age Requirements

These terms govern your use of Radme.ru’s product MyRenovation app, as well as the web platforms at bestrenovate.com and bestrenovate.ru (collectively referred to as the «Platform» or «Services»), including its features, apps, services, technologies, and software we offer. The Platform is designed for informational, analytical, and computational support of construction and renovation processes. Use of the Platform is recognized as full acceptance of the conditions of this Agreement and our Privacy Policy.

Age Restriction: You must be at least 13 years old to use the Services. By agreeing to these Terms, you represent and warrant to us that you are at least 13 years old. If you are under 18 years of age, you may use the Services only with the involvement and consent of a parent or legal guardian.

2. Subject of the Agreement & Software License

The Administration grants the User a non-exclusive license to access the basic and extended functionality of the Platform. The rights granted include the placement of project information about real estate and the use of computational modules. MyRenovation gives you a personal, worldwide, royalty-free, non-assignable and nonexclusive license to use the software provided to you as part of the Services. This license is for the sole purpose of enabling you to use and enjoy the benefit of the Services as provided by MyRenovation, in the manner permitted by these terms. All exclusive rights to the software code, databases, and design elements belong to the Administration. You may not copy, modify, distribute, sell, or lease any part of our Services or included software, nor may you reverse engineer or attempt to extract the source code of that software.

3. Using Our Services & User Responsibilities

You must follow any policies made available to you within the Services. Don’t misuse our Services. For example, don’t interfere with our Services or try to access them using a method other than the interface and the instructions that we provide.

The User specifically agrees to:

• Not violate the legislation of the applicable jurisdiction.

• Not use or introduce malicious software.

• Not carry out automated data collection (parsing) of the Platform’s data.

We may suspend or stop providing our Services to you if you do not comply with our terms or policies or if we are investigating suspected misconduct. Most of our Services are available on mobile devices. Do not use such Services in a way that distracts you and prevents you from obeying traffic or safety laws.

4. Tariffs and Paid Services

Basic access to the Platform is provided free of charge. Extended functionality and advanced calculation modules are provided via a paid subscription according to the approved Tariff Plans. Payment is processed securely through integrated payment gateways provided by our acquiring partners. Your use and/or purchase of Services are all at your sole risk.

5. Your MyRenovation Account & Content

You may need a MyRenovation Account in order to use some of our Services. To protect your MyRenovation Account, keep your password confidential. You are responsible for the activity that happens on or through your MyRenovation Account.

Some of our Services allow you to create, upload, submit, save, send or receive content (such as property details or renovation budgets). You retain ownership of any intellectual property rights that you hold in that content. What belongs to you stays yours.

Content License: However, by uploading, submitting, storing, or receiving content to or through our Services, you grant MyRenovation (and those we work with) a worldwide, royalty-free, non-exclusive license to use, host, store, reproduce, modify, create derivative works, and distribute such content. This license is for the limited purpose of operating, promoting, and improving our Services.

6. Copyright Protection & DMCA Notice

We respect the intellectual property of others and ask that our users do the same. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via the Services, please notify MyRenovation’s copyright agent, as set forth in the Digital Millennium Copyright Act of 1998 (DMCA). For your complaint to be valid under the DMCA, you must provide the necessary information in writing to our support team at support@bestrenovate.ru.

7. Warranties and Disclaimers

We provide our Services using a commercially reasonable level of skill and care, and we hope that you will enjoy using them. However, the Platform is provided on an «AS IS» basis.

OTHER THAN AS EXPRESSLY SET OUT IN THESE TERMS, NEITHER MYRENOVATION NOR ITS SUPPLIERS MAKE ANY SPECIFIC PROMISES ABOUT THE SERVICES. THE ADMINISTRATION DOES NOT GIVE DIRECT GUARANTEES OF ABSOLUTE ERROR-FREE OR UNINTERRUPTED OPERATION OF THE SERVICE. TO THE EXTENT PERMITTED BY LAW, WE EXCLUDE ALL WARRANTIES.

WE CANNOT PREDICT WHEN ISSUES MIGHT ARISE WITH OUR SERVICES. ACCORDINGLY, OUR LIABILITY SHALL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AND UNDER NO CIRCUMSTANCE WILL WE BE LIABLE TO YOU FOR ANY LOST PROFITS, REVENUES, INFORMATION, OR DATA, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATED TO THESE TERMS.

8. Indemnification

If you are using our Services on behalf of a business, that business accepts these terms. Furthermore, you (and your business) will hold harmless and indemnify MyRenovation and its affiliates, officers, agents, and employees from any claim, suit or action arising from or related to the use of the Services or violation of these terms, including any liability or expense arising from claims, losses, damages, suits, judgments, litigation costs and attorneys’ fees.

9. Governing Law, Arbitration, and Class Action Waiver

Governing Law: These Terms and any dispute arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Russian Federation, without giving effect to any principles of conflicts of law.

Binding Arbitration and Class Action Waiver: You and MyRenovation agree that any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, shall be resolved by binding arbitration, rather than in court. YOU AND MYRENOVATION AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

10. Modifying and Terminating Our Services

We may modify these terms or any additional terms that apply to a Service to reflect changes to the law or changes to our Services. We’ll post notice of modifications to these terms on this page. Changes will not apply retroactively and will become effective no sooner than fourteen days after they are posted, except for changes addressing new functions or legal reasons, which will be effective immediately.

Severability: If it turns out that a particular term is not enforceable, this will not affect any other terms.
